Terms of Use. Including the free work offer.

Plain terms for using this website and for the 4 hours of free work we offer. Paid projects are covered by a separate agreement we sign with you.

1. About these terms

These terms apply when you use this website or take up our free work offer. They are between you and Kernly Design ("we", "us"). By using the site or claiming free work, you agree to them.

2. Our services

The site describes our design services. Prices, timelines and examples are a guide, not an offer we must accept. Paid work starts only once we agree a scope and quote with you in writing, and that agreement takes priority over these terms.

3. The free work offer

4. Who owns the work

Free work: once we deliver it, you may use it for your business.

Paid work: ownership of the final work passes to you when the project is paid in full, as set out in the project agreement.

We keep the right to our own tools, templates and know-how. Unless you agree, we will not show your work in our portfolio or name you as a client.

5. Your materials

You keep ownership of everything you share with us, such as briefs, logos, images and copy. By sharing them, you confirm you have the right to, and you allow us to use them to do the work.

6. Confidentiality

We treat your briefs and business information as confidential and use them only to work with you. We are happy to sign a non-disclosure agreement before you share anything.

7. Using this website

The design, text, images and code of this site belong to Kernly Design or to the clients whose work we show with permission. You may view and share pages, but please don't copy or reuse them without our permission.

Please don't misuse the site, for example by sending spam through the forms or trying to disrupt it.

The site may link to other websites. We are not responsible for their content or how they handle your data.

9. Liability

We work hard to keep the site accurate and available, but it is provided "as is", and the free work is provided without any guarantee of results. To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profit, arising from the site or the free work. Nothing in these terms limits any liability that cannot be limited by law.

10. Changes and contact

We may update these terms from time to time. The date at the top shows when they last changed.
